Rules for Driving in Cape Hatteras National Seashore

Driving on the beach has long been an Outer Banks favorite for many.  There are certain rules that regulate beach driving.  Below you will find the rules for the Cape Hatteras National Seashore.  The rules for the National Park are enforced by the NPS. 

 

  • Nighttime ORV use is prohibited from 10 p.m. to 6 a.m. from May 1 - November 15
  • Drive only on marked ORV routes and comply with posted restrictions
  • Observe posted speed limits
  • If violations of protected species closures results in disturbance or harassment of wildlife or the vandalization of fencing, nests, or plants; the closure is mandated to be expanded 50 m for the first violation, 100 m for the second, and 500 m for the third.  Violators are subject up to a $5,000 fine and/or imprisonment up to 6 months.
  • Current driver's license, registration, and license plates on all cars and ATV's
  • Be sure to only use designated beach access (Stay off the Dunes)
  • No driving or parking on the wrack line.
  • Pedestrians like anywhere have the Right of Way
  • Open alcoholic beverages are prohibited while driving
  • Must use seatbelts
  • When sitting in the open area of a vehicle passengers must be seated on the floor with the tailgate up.
